Tender Compliance Checklist Every SME Needs

When it comes to tenders, the list of requirements is long, detailed and, frankly, quite complex for business owners. The requirements get even more complicated once you add in compliance and due diligence processes.

Small to medium-sized enterprises (SMEs) applying for tenders need to have a core compliance master file. This file will prevent immediate disqualification, save time on tight deadlines, and ensure that all mandatory administrative, tax, and technical criteria are fully met before submission.

In this article, we look at what tender compliance is and what a comprehensive tender compliance checklist looks like for SMEs who need it.

What is Tender Compliance?

Tender compliance is the process of ensuring that all aspects of a procurement tender – documents, submissions, evaluations, and decisions – adhere to internal policies, legal regulations, and contractual requirements. It ensures fairness, transparency, and accountability throughout the procurement lifecycle while reducing regulatory and financial risks. Strong tender compliance is a key component of effective procurement governance.

Key Core Components of Tender Compliance

Tender compliance is built on multiple layers of checks and controls that ensure adherence to rules and standards. Key components include:

  • Regulatory compliance
  • Ethical standards
  • Vendor due diligence
  • Financial integrity
  • Internal policy alignment

These components ensure that procurement activities are conducted responsibly and in line with regulatory expectations.

Tender Compliance Checklist

In some cases, tender applications are rejected because of missing or incomplete documentation. Use this checklist to ensure your bid is compliant before you submit. Remember, this checklist is a blueprint; you must cross-reference it with the specific tender’s requirements.

Section 1: Company Registration and Compliance Documents

These are the documents that prove that your business is legally registered, tax compliant and eligible to do business with the government. You will need the following:

  • Central Supplier Database Report (supplier registration summary)
  • Tax compliance status
  • B-BBEE certification or sworn affidavit
  • CIPC company registration
  • CIBD registration certificate
  • COIDA Letter of Good Standing
  • Company resolution
  • Director ID documents

Section 2: Standard bidding documents (SBD forms)

Complete these forms from the actual tender pack; do not use generic versions, and ensure they are all signed and dated. Key documents include:

  • SBD 1 – Invitation to bid form must be signed and dated
  • SBD 3.1/3.2/3.3 – Pricing schedule form that must be completed using the correct format (firm/non-firm/professional)· SBD 4 – Declaration of interest form must be completed even if not applicable
  • SBD 6.1 – Preference points claim form must match your uploaded B-BBEE certificate
  • SBD 6.2 – Local content declaration form, which is only required for designated sectors (check if applicable to your tender)
  • SBD 8 – Past SCM practices form to be used to declare any restrictions, fraud conviction or SCM abuse
  • SBD 9 – Independent bid determination must be signed, as omission can lead to automatic disqualification

Section 3: Technical and Functional Documents

These documents are evaluated for technical/functional scoring. The specific requirements vary per tender, check the Terms of Reference carefully. Key required documents:

  • Technical proposal/methodology – Detailed approach to delivering the scope of work
  • Project plan/programme – Timeline showing key milestones and deliverables
  • Team CVs and qualifications – CVs of key personnel with certified copies of qualifications
  • Track record/experience – List of similar completed projects with contactable references
  • Method statements – For construction: safe work procedures for high-risk activities
  • Health and safety plan – Health and safety plan as per Construction Regulation 7 (1)
  • Quality management plan – Quality assurance procedures and inspection checklists
  • Risk assessment (HIRA) – Hazard identification and risk assessment for scope of work

Section 4: Final Submission Checklist

Before submitting your tender application, ensure the following:

  • Original and required number of document copies
  • Sealed envelope(s) labelled with bid number, company name and closing date
  • Submit before closing time (usually 11:00 or 12:00)
  • Keep a certified copy of the completed submission
  • Initial all pages (if required by tender conditions)
  • Confirm correct tender box location
  • Receive proof of submission (electronic copy if e-submission)

Common Document Mistakes and How to Avoid Them

The following are some of the mistakes businesses make when applying for a tender and how to avoid them.

Mistake 1: Expired Certificates

If your tax clearance or B-BBEE certificates are expired, it is an automatic disqualification.

Solution:

  • Check all certificate expiry dates
  • Renew 30 days before expiry
  • Set calendar reminders
  • Don’t assume; always verify expiration dates

Mistake 2: Missing Signatures

Unsigned SBD forms lead to automatic disqualification.

Solution:

  • Create a checklist of signature requirements
  • Check every page for signature blocks
  • Use authorised signatory (per CIPC)
  • Have a backup signatory if needed

Mistake 3: Uncertified ID copies

If the directors’ IDs are not certified, you will be disqualified.

Solution:

  • Get IDs certified every 3 months
  • Use a commissioner of oaths, police or a lawyer
  • Ensure “Certified true copy of original” statement
  • Include certifier’s stamp and signature

Mistake 4: Company Name Mismatch

If the company names on the B-BBEE certificate do not match CIPC documents, it leads to an automatic disqualification for non-compliance.

Solution:

  • Use the exact company name as registered with the CIPC
  • Check spelling and punctuation
  • Update certificates if the company name changed
  • Ensure consistency across all documents

Mistake 5: Incorrect Banking Details

If you submit your personal account instead of a business bank account, you will not be paid even if you win the bid.

Solution:

  • Use the company bank account only
  • Verify the account holder name matches the company
  • Triple-check the account number
  • Include the branch code

Mistake 6: Incomplete SDB form

Leaving blank fields on SDB forms will lead to disqualification for non-compliance.

Solution:

  • Complete every field on SDB forms
  • Write “N/A” or “Not applicable” if the field doesn’t apply
  • Don’t leave blanks
  • Read instructions on each form carefully to understand formatting

Mistake 7: Using Generic Documents

Using generic documents can lead to submitting incorrect forms, bidding for the wrong tender or incorrect client. This looks unprofessional and may cause disqualification.

Solution:

  • Customise documents for each tender bid
  • Reference the correct tender number throughout
  • Tailor case studies to tender requirements
  • Remove competitor/other client mentions
